SCOTUS ruling brings uncertainty

Last week’s U.S. Supreme Court ruling on the sweeping tariffs implemented by the Trump administration has added more complexity to an already uncertain trade environment. While the decision offers some clarity on the constitutional separation of powers, it has also created short-term disruption and confusion for businesses that rely on predictable rules to plan, invest and grow. 

In the days following the ruling, I’ve communicated with over 50 local business leaders to gain perspective. The message was consistent: clarity is still lacking. That feedback aligns with what MMAC has heard from our broader membership since these tariffs were first implemented last year. 

Our position is grounded in collective input and has stayed consistent. Tariffs are a tax. Like any tax, they must be measured, targeted and borne of clear legal authority. There are circumstances where narrowly tailored tariffs can be an appropriate policy tool – particularly when addressing unfair trade practices or national security concerns. However, those efforts must be precise and strategic. A one size fits all approach ultimately harms businesses, workers and consumers alike. 

Over time, we hope the Court’s decision helps reduce some of that uncertainty by reaffirming the constitutional roles of the branches of government and restoring the power of the purse in tariff matters to the U.S. Congress. 

Unfortunately, Congress has shown little interest in exercising that authority, or any authority at all on our most pressing issues. That lack of engagement only reinforces the need for policymakers to provide clearer, more stable frameworks that allow businesses to compete and grow with confidence. 

MMAC will continue to closely monitor developments and advocate in the best interests of our members. We will share this perspective with elected officials and the public, emphasizing the importance of certainty, stability and sound economic policy.
